How to Deal with Domestic Violence During Divorce
Sometimes divorce gets rather contentious. Things are said and voices rise. However, no one should ever fear for their safety during a separation or divorce. Sometimes people who never expected to fear for their safety become victims of domestic violence during divorce proceedings. Here are some things to do. Of course, if you are in immediate danger, call 911. You can also reach out to the National Domestic Violence Hotline at 800-799-7233 or text BEGIN to 88788.
Document Everything
Domestic violence during divorce is common. When it does happen, it can be difficult to see the person you once loved turn into something you never imagined. However, if they begin verbally abusing you or physically harming you, document everything as soon as you can. Take photos of bruises, scratches, or other harm done. Also photograph the after effects of the fight that include damage to personal property. One suggestion is to email the photographs and the details of the abuse to a trusted friend or, if you have an attorney, to them. This will ensure that the perpetrator does not delete them from your phone leaving you with no evidence.
Talk with Your Attorney About an Injunction for Protection Against Domestic Violence
If you are suffering from domestic violence during divorce, your divorce attorney can help you with an injunction (commonly called a restraining order). However, you must demonstrate, with evidence, a reasonable fear that you (and/or your children) are in danger. And, that danger must be imminent. This is why it is so important to document everything in as much detail as possible.
The injunction can protect you against any form of domestic violence or abuse. This includes any type of assault, stalking, imprisonment, and kidnapping. The courts will review the behaviors of both parties in reports from law enforcement as well as the detailed statements from both parties. You must prove that you are in immediate danger for your (or a loved one’s) life or safety.
